You will not be able to make purchases without accepting the applicability of the rules set below governing our relationship. We recommend that you read them carefully and make sure you fully understand them to ensure an optimal experience.<\/p><p>From a legal standpoint, this contract (hereinafter referred to as &#8220;Terms and Conditions&#8221; or &#8220;T&amp;C&#8221;) is entered into between you and PUFULETE S.R.L., the entity that owns and operates the website www.pufuleti.ro. The identification details of the company are as follows:<\/p><p>S.C. PUFULETE S.R.L., a legal entity of Romanian nationality, having its registered office in <a href=\"https:\/\/maps.app.goo.gl\/vWw5wuSi3v5XwM3H9?g_st=aw\" target=\"_blank\" rel=\"noopener\">Bu\u0219ag, 123 Str., No. 5-10-12, T\u0103u\u0163ii-M\u0103gher\u0103u\u015f city, Maramure\u0219 county<\/a>, Unique Registration Code (CUI) RO 15800214, Trade Register Registration Number: J24\/1141\/2003, e-mail: <a href=\"mailto:office@pufuleti.ro\">office@pufuleti.ro<\/a><\/p><ol><li><strong>DEFINITIONS<\/strong><\/li><\/ol><p>Throughout these Terms and Conditions (T&amp;C), we will repeatedly use certain words and terms. For maximum clarity, we explain below the meaning of each term used:<\/p><p><strong>Seller<\/strong> (<strong>We<\/strong> \/ <strong>Us<\/strong>) \u2013 the commercial company PUFULETE S.R.L.<\/p><p><strong>Buyer<\/strong> \u2013 any individual who is at least 18 years of age, or any legal entity having access to the Content, who places an Order on the Site and confirms it through any communication channel made available by PUFULETE S.R.L. (electronic, telephone, etc.).<\/p><p><strong>User<\/strong> \u2013 any individual who is at least 18 years of age, or any legal entity accessing the Site who, by completing the ordering process for a Product\/Bundle, agrees to the specific site clauses outlined in the Terms and Conditions section.<\/p><p><strong>Site<\/strong> \u2013 the webpage hosted online at pufuleti.ro and its subdomains.<\/p><p><strong>Product<\/strong> \u2013 any category of NICOOLE or P\u2019UFO branded corn puffs listed on the Site, individually or in a Bundle, to be supplied by the Seller to the Buyer as a result of a confirmed order\/transaction.<\/p><p><strong>Campaign<\/strong> \u2013 the act of displaying a limited number of Products for commercial purposes, with limited and predefined stock, for a specified period set by the Seller.<\/p><p><strong>Content<\/strong> \u2013 represents:<\/p><ul><li>all information on the Site that can be visited, viewed, or accessed by using electronic equipment;<\/li><li>the content of any e-mail sent to Buyers by the Seller via electronic means and\/or any other available communication method;<\/li><li>any information communicated through any means by an employee or partner of the Seller to the Buyer, according to the contact information specified or not by the Buyer;<\/li><li>information related to Products and prices applied by the Seller within a specific period;<\/li><li>data related to the Seller.<\/li><\/ul><p><strong>Document<\/strong> \u2013 these Terms and Conditions (T&amp;C).<\/p><p><strong>Commercial Communications<\/strong> \u2013 any type of message sent via e-mail\/SMS\/telephone containing general and thematic information, details about products similar or complementary to those purchased by the Buyer, information regarding offers or promotions, data about Products available on the Site, as well as other commercial messages such as news, promotional offers, or opinion surveys.<\/p><p><strong>Order<\/strong> \u2013 the operation by which you complete the online form titled &#8220;Order&#8221; in the &#8220;Shop&#8221; section directly on the Site and subsequently pay the value of the ordered Bundles.<\/p><p><strong>Transaction<\/strong> \u2013 the collection of an amount resulting from the sale of a Product by PUFULETE S.R.L. to the Buyer using cash on delivery courier services, bank transfer (card payment), or any other payment method agreed upon by the Seller.<\/p><p><strong>Specifications<\/strong> \u2013 all specifications and descriptions of the Products.<\/p><ol start=\"2\"><li><strong>GENERAL CONDITIONS<\/strong><ul><li>The Terms and Conditions regulate all relationships between you and Us, before, during, and after placing an Order;<\/li><li>At the time of placing the Order, the specific conditions of each ordered Product become an integral part of the Terms and Conditions, together forming the distance contract concluded electronically between you and Us;<\/li><li>Purchasing Products through the Site implicitly requires your unconditional acceptance of the Terms and Conditions (including the Specific Conditions of the ordered Products);<\/li><li>By accepting the T&amp;C, we consider that you implicitly and unconditionally express your agreement with our Privacy Policy (insert link), Cookie Policy (insert link), as well as any other documents to which we explicitly refer in the T&amp;C. Please treat these documents as an integral part of the contract concluded with us and review them carefully.<\/li><\/ul><\/li><\/ol><ol start=\"3\"><li><strong>CONTRACTUAL DOCUMENTS<\/strong><\/li><\/ol><p>3.1. Access to the Site is permitted to any person acting for a legitimate purpose, complying with the T&amp;C, and intending to purchase one or more Products.<\/p><p>3.2. By ordering a Product through the Shop on the Site, the Buyer agrees to the form of communication (telephone or e-mail) through which the Seller conducts its commercial operations.<\/p><p>3.3. The notification received by the Buyer after submitting the online order serves as acceptance of the Product. This notification is sent electronically (e-mail) or made via telephone.<\/p><p>3.4. For justified reasons, the Seller reserves the right to modify the quantity of Products on the Site or their prices. If the quantity of transacted Products or their price is modified, the Seller will notify the Buyer at the e-mail address or phone number provided when completing the online form and will request re-confirmation of the order or its value before dispatch.<\/p><p>3.5. The information provided by Us on the Site regarding Products and availability shall form the basis of the purchase.<\/p><ol start=\"4\"><li><strong>ONLINE SALES POLICY<\/strong><\/li><\/ol><p>4.1. Access to conduct an online transaction is allowed to any User.<\/p><p>4.2. Communication with the Seller can be made through direct interaction, via WhatsApp if the option is active, or through the e-mail address listed in the &#8220;Contact&#8221; section of the Site. The Seller has the freedom to manage received information without being required to provide justifications.<\/p><p>4.3 In the event of an unusually high volume of traffic originating from an internet network, We reserve the right to require Users\/Buyers to manually enter captcha validation codes to protect the information on the Site.<\/p><p>4.4. We may publish information on the Site about Products or active promotions within a specific time frame and subject to available stock.<\/p><p>4.5. All prices for Products displayed on the Site are expressed in Romanian Lei (RON) and include V.A.T.<\/p><p>4.6. Subject to applicable legal provisions, the Product prices displayed on the Site include Value Added Tax, at the percentage rate set by authorities at the time of the order. If the User\/Buyer requests details regarding the exact amount added to the net price of the Product, they can contact the Seller at office@pufuleti.ro or at the telephone numbers listed on the Site.<\/p><p>4.7. In the case of online payments, the Seller is not and cannot be held responsible for any additional costs incurred by the Buyer, including but not limited to currency exchange fees or bank transaction fees applied by the Buyer&#8217;s issuing bank. Responsibility for such charges rests solely with the Buyer.<\/p><p>4.8. All information used to describe Products available on the Site (images \/ video \/ multimedia presentations \/ etc.) does not represent a contractual obligation on the part of the Seller, serving solely for presentation purposes.<\/p><p>4.9. 10 (ten) days after purchasing Products, the Buyer may be asked to write a Review on our Facebook page regarding the purchased Products. The request will be sent to the e-mail address entered by the Buyer in the Site form. In this way, the Buyer helps inform other potential Customers\/Buyers and actively participates in developing new Products and detailing Product features as completely as possible.<\/p><ol start=\"5\"><li><strong>ASSIGNMENT AND SUBCONTRACTING<\/strong><\/li><\/ol><p>The Seller may assign to a third party (courier company) services related to order fulfillment (home delivery), with prior notice to the Buyer. The Seller will always remain fully transparent toward the Buyer regarding all contractual obligations.<\/p><ol start=\"6\"><li><strong>INTELLECTUAL PROPERTY RIGHTS<\/strong><\/li><\/ol><p>6.1. The Content, as defined in the preamble\u2014including but not limited to logos, stylized representations, commercial symbols, static images, text, and\/or multimedia content displayed on the Site\u2014is the exclusive property of the Seller, with all rights obtained directly or indirectly reserved.<\/p><p>6.2. The Buyer is not permitted to copy, distribute, publish, modify, alter, use, display, or include any Content in any context other than the original intended by Us, nor to feature any Content outside the Site, remove copyright notices indicating PUFULETE S.R.L.&#8217;s ownership of the Content, or participate in the transfer or distribution of materials created by reproducing, modifying, or displaying Content without the express written consent of PUFULETE S.R.L.<\/p><p>6.3. No Content transmitted to the User or Buyer through any communication means (electronic, telephone, etc.) or acquired through accessing, visiting, and\/or viewing constitutes a contractual obligation on the part of PUFULETE S.R.L. regarding that specific content.<\/p><ol start=\"7\"><li><strong>THE ORDER<\/strong><\/li><\/ol><p>7.1. The Buyer can place an Order on the Site in the Shop section, depending on availability provided by the Seller, by selecting the desired Products and completing the Order by paying via one of the expressly indicated methods (cash on delivery to the courier, online bank card payment). Once ordered, the Product will be confirmed and dispatched within the timeframe communicated by Us to the Buyer.<\/p><p>7.2. By finalizing the Order, the Buyer confirms that all data provided for the purchase process is accurate, complete, and true at the date of filling out the online form on the Site.<\/p><p>7.3. By finalizing the Order, the Buyer agrees that the Seller may contact them via any channel provided by the Seller to confirm details, the order, pricing, or whenever contact with the Buyer is necessary.<\/p><p>7.4. Products are ordered exclusively online by adding them to the shopping cart and completing the checkout process.<\/p><p>7.5. An Order is considered placed after completing online payment (by card) or choosing the cash-on-delivery payment method.<\/p><p>7.5.1. Payment methods:<\/p><ul><li><strong>Online by card<\/strong> (Visa, Mastercard, Maestro) \u2013 processed through a secure payment gateway.<\/li><li><strong>Cash on delivery<\/strong> \u2013 cash payment directly to the courier upon receipt.<\/li><\/ul><p>7.5.2. Prices displayed on the Site are expressed in Romanian Lei (RON) and include V.A.T.<br \/>7.5.3. The Seller will issue a tax invoice for all orders, transmitted electronically to the Buyer&#8217;s e-mail address or included inside the parcel.<\/p><p>7.6. Prior to order processing, you will be contacted by telephone by a PUFULETE S.R.L. representative to confirm delivery details and receiving availability.<\/p><p>7.7. Products ordered on <a href=\"http:\/\/www.pufuleti.ro\">www.pufuleti.ro<\/a> will be delivered via express courier within <strong>2\u20133 business days<\/strong> from order confirmation to the address specified by the client.<\/p><ol start=\"8\"><li><strong>PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL DOES NOT APPLY<\/strong><\/li><\/ol><p>8.1. The following are exempted from the right of withdrawal:<\/p><p>8.1.1. Orders canceled after a longer timeframe than specified on the site, if the Buyer confirmed reading and agreeing to the Seller&#8217;s conditions prior to order dispatch;<\/p><p>8.1.2. Orders with extended delivery times due to courier distribution schedules or remote geographical coverage areas, provided the delivery timeframe was agreed upon in advance by the Buyer and the Seller has no direct control over courier logistics.<\/p><p>8.2. Online orders can be canceled within <strong>24 hours<\/strong> of submission via e-mail to office@pufuleti.ro or by direct phone call, quoting the order number.<\/p><p>8.3. If the product has already been dispatched to the courier service and the cancellation request is justified and accepted, the order value will be refunded within a maximum of <strong>14 calendar days<\/strong>, minus shipping costs, which will be deducted from the refunded amount.<\/p><p>8.4. For orders paid online by card, refunds will be issued back to the original card used for the transaction.<\/p><ol start=\"9\"><li><strong>CONFIDENTIALITY<\/strong><\/li><\/ol><p>9.1. We will maintain strict confidentiality regarding information of any nature disclosed to us by the User or Buyer. Disclosure of provided information or personal data will only take place under the conditions set out in this Document.<\/p><p>9.2. No public statement, promotion, press release, or any other form of disclosure to third parties shall be made by the Buyer regarding an Order without prior written consent from the Seller.<\/p><ol start=\"10\"><li><strong>COMMERCIAL COMMUNICATIONS<\/strong><\/li><\/ol><p>10.1. The Buyer may modify their choice regarding consent given to the Seller for Commercial Communications containing general or thematic information (including details on offers or promotions) at any time as follows:<\/p><p>10.1.1. by accessing the unsubscribe link displayed within Commercial Communications received from the Seller;<\/p><p>10.1.2. by contacting the Seller directly.<\/p><p>10.2. Following a Product purchase on the Site, the Seller may send the Buyer Commercial Communications regarding:<\/p><ul><li>Completing a feedback survey about Products and\/or delivery service.<\/li><li>Special offers and promotions.<\/li><\/ul><p>10.3. The User can unsubscribe at any time from the Commercial Communications mentioned in section 10.2 above by contacting the Seller.<\/p><p>10.4. Additionally, to improve our Product line and shopping experience, we will use your data to conduct market research and opinion polls. Information obtained from market research and opinion polls will not be used for advertising purposes, but exclusively for the purposes stated above. Your survey responses will not be linked to your identity, transmitted to third parties, or published. You can object to the use of your data for market research and opinion polls at any time by clicking the unsubscribe link included in messages sent by the Seller.<\/p><ol start=\"11\"><li><strong>PAYMENT<\/strong><\/li><\/ol><p>11.1. Product prices displayed on www.pufuleti.ro include V.A.T. in accordance with current legislation.<\/p><p>11.2. The price, payment method, and shipping costs will be specified upon confirmation of each Order by the Seller.<\/p><p>11.3. Payment methods:<\/p><ul><li><strong>Online by card<\/strong> (Visa, Mastercard, Maestro) \u2013 processed through a secure payment processor.<\/li><li><strong>Cash on delivery<\/strong> \u2013 cash payment directly to the courier.<\/li><\/ul><p>11.4. The Seller will issue an invoice to the Buyer for the purchased Products, and the Buyer is obligated to accurately provide all necessary invoicing details in accordance with current legislation.<\/p><p>11.5. The Seller will transmit the invoice corresponding to the Order containing Products sold by Us in electronic format to the e-mail address provided by the Buyer or physically inside the parcel.<\/p><ol start=\"12\"><li><strong>PRODUCT DELIVERY<\/strong><\/li><\/ol><p>Delivery conditions for Products in the Seller&#8217;s portfolio are available on the site when completing the Order.<\/p><p>12.1. Deliveries are carried out via express courier within 2\u20133 business days from order confirmation.<\/p><p>12.2. The delivery cost is displayed in the shopping cart prior to finalizing the order.<\/p><p>12.3. Delivery time may vary depending on destination location, order volume, and product availability.<\/p><ol start=\"13\"><li><strong>LIABILITY<\/strong><\/li><\/ol><p>The Seller reserves the right to periodically update and modify the T&amp;C section on the Site to reflect changes in how the Site operates or updates in legal requirements. This Document is binding on Users from the moment it is published on the Site.<\/p><p>In the event of any modification, we will display the updated version of the Document on the Site, which is why we kindly ask you to review this section periodically.<\/p><ol start=\"14\"><li><strong>WRITING REVIEWS<\/strong><\/li><\/ol><p>14.1. Reviews can be submitted by the Buyer via e-mail, in the messaging section of the Pufule\u021bi NICOOLE Facebook page, or in the &#8220;Reviews&#8221; section of the Facebook page. Written feedback can be positive or negative and must relate to Product characteristics.<\/p><p>14.2. By submitting a Review on social networks, WhatsApp, or e-mail, the User\/Buyer grants the Seller a non-exclusive, irrevocable, geographically unlimited license and the right to use, reproduce, modify, adapt, publish, distribute, and display this content.<\/p><p>14.3. Every User\/Buyer submitting a Review in the mentioned sections agrees to follow these rules:<\/p><p>\u2013 refer only to characteristics and\/or consumption experiences of a specific Product, avoiding details on aspects that may change (such as price or promotional offers) or details regarding online order processing;<\/p><p>\u2013 use appropriate language, free from terms that could offend or affect any other User\/Buyer;<\/p><p>\u2013 ensure that submitted information is realistic, accurate, not misleading, and compliant with applicable laws, thereby respecting third-party rights, copyrights, trademarks, or other proprietary or privacy rights;<\/p><p>\u2013 avoid providing or requesting, in any way or measure, personal data (contact details, home addresses, phone numbers, e-mail addresses, full names, etc.) or any other info that could reveal personal identities;<\/p><p>\u2013 refrain from posting links or information regarding URLs from competing commercial websites engaged in similar business activities to the Seller;<\/p><p>14.4. In addition to a realistic evaluation, when writing a Review, the Buyer may attach a relevant rating according to available platform options. Users\/Customers who attach photo or video files to Reviews must observe the following rules:<\/p><p>\u2013 uploaded files must contain photos and\/or videos strictly related to the reviewed product, ensuring that uploaded files respect copyright laws;<\/p><p>\u2013 uploaded files must not contain violence, adult content, offensive language, or content that offends individuals or groups based on race, ethnic origin, religion, disability, gender, age, veteran status, sexual orientation, or political views;<\/p><p>\u2013 uploaded files must not contain personal information belonging to third parties;<\/p><p>14.5. For complaints or inquiries regarding purchased Products, Buyers can use the e-mail address listed in the Contact section. The maximum resolution timeframe for complaints is 30 calendar days from receipt.<\/p><ol start=\"15\"><li><strong>PROCESSING OF PERSONAL DATA<\/strong><\/li><\/ol><p>Please review our Privacy Policy (link) regarding the processing of personal data, which forms an integral part of this Document.<\/p><ol start=\"16\"><li><strong>USE OF COOKIES<\/strong><\/li><\/ol><p>Please see our Cookie Policy (link), which forms an integral part of this Document.<\/p><ol start=\"17\"><li><strong>FORCE MAJEURE<\/strong><\/li><\/ol><p>17.1. Neither party shall be held liable for non-performance of contractual obligations if such non-performance on time and\/or properly, in whole or in part, is due to a force majeure event. Force majeure is an unpredictable event beyond the control of the parties that cannot be avoided or controlled.<\/p><p>17.2. If within 15 (fifteen) days from its occurrence, the force majeure event does not cease, each party shall have the right to notify the other of the automatic termination of the contractual relationship without either party being entitled to claim damages.<\/p><ol start=\"18\"><li><strong>APPLICABLE LAW<\/strong><\/li><\/ol><p>This document is governed by Romanian law. Any disputes arising between Us and you as a User \/ Buyer will be settled amicably.
